Court No. - 35 Case :- WRIT - A No. - 13286 of 2023 Petitioner :- Meenu Sharma Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Divyanshu Nandan Tripathi,Utkarsh Khanna Counsel for Respondent :- C.S.C.,Avneesh Tripathi,Prabhakar Awasthi Hon'ble Vikas Budhwar,J.
¶1Heard Shri Divyanshu Nandan Tripathi and Utkarsh Khanna, learned counsel for the writ petitioner, learned Standing Counsel as well as the counsel for the University appearing for the sixth respondent.
¶2Principally, the challenge raised in the writ petition is an order dated 16.06.2023 passed by the Chaudhary Charan Singh University, Meerut whereby on an exercise undertaken the sixth respondent has been making senior to the writ petitioners. Learned counsel for the writ petitioners submits that though he has armed with judgment while supporting his case, however, he submits that since there exists an alternative remedy of a reference put a chancellor under Section 68 of the U.P. Universities Act, 1973, thus , according to him, the writ petitioner be permitted to take recourse to the said remedy.
¶3To such a submission, learned counsel for the respondents have no objection.
¶4Considering the submission of the rival parties as well as stand taken by them, the writ petition is being disposed of granting liberty to the writ petitioner to take recourse, the provisions under Section 68 of the U.P. Universities Act, 1973 and in case such a reference is being preferred then this Court has no reasons to disbelieve that the same will be decided with most expedition in a reasonable period, as according to the writ petitioner, the sixth respondent is getting undue benefits by virtue of the order dated
16.03.2023 of the University.
¶5With the aforesaid observations, the writ petition is disposed of. Order Date :- 19.10.2023/A. Prajapati High Court of Judicature at Allahabad
