1.Heard Mr. Aprajit Yadav, learned counsel for the petitioners, Mr. Shirdhar Tripathi, learned Standing Counsel for the respondents and Mr. Azad Rai, learned counsel for respondent No.2/Gram Panchayat.

2.The instant writ petition has been filed praying for a mandamus directing respondent No.1/Commissioner Prayagraj Division, Prayagraj to decide the appeal computerized Case No. C-202102000000697 under Section 207 of U.P. Revenue Code, 2006 within stipulated period.

¶3Learned counsel for the petitioners submitted that the aforementioned appeal filed at the instant of contesting respondents under Section 207 of U.P. Revenue Code, 2006 is pending since 26.08.2021. He further placed the certified copy of the order sheet which has been annexed as Annexure No.7 to the writ petition in order to demonstrate that the case is not proceeding expeditiously.

¶4Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No.1/Commissioner Prayagraj Division, Prayagraj to consider and decide the aforementioned appeal in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
