Judgment

Court No. - 6 Case :- WRIT - C No. - 13225 of 2023 Petitioner :- M/S Karan Construction Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Sushil Kumar Tewari Counsel for Respondent :- C.S.C.,Bhupendra Kumar Tripathi Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Sushil Kumar Tewari, learned counsel for the petitioner and learned Standing Counsel for the State. The writ petition has been filed by the petitioner with a prayer to direct the respondents to release the payment of Rs.2,48,410.55/- to the petitioner in lieu of construction of Panchayat Bhawan carried out in the year 2020-21, in Gram Sabha Bazar Kalika, Block Sewapuri, District Varanasi. Learned counsel for the petitioner submits that petitioner is a duly registered establishment under the proprietorship of Sri Yogendra Singh. He further submits that construction of Panchayat Bhawan was carried out in the concerned Village Panchayat, for which, the petitioner supplied material like Cement, Bricks e.t.c. from

21.02.2021 till 08.03.2021. After completion of construction work, he placed the bills before respondents but no payment has been released till date. A civil suit was filed by one Devi Prasad claiming therein that the land on which the Panchayat Bhawan is being constructed belongs to him, however, the aforesaid suit is pending. Despite passage of time more than two years, the aforesaid payment has not been released in favour of the petitioner. Learned Standing Counsel on the other hand submits that it is the concerned Pradhan along with his team, who has to certify as to whether the material for construction of Panchayat Bhawan has been supplied by the petitioner or not. There is nothing on record to show that Pradhan along with his team has certified that the petitioner has supplied material, therefore, the relief as prayed cannot be granted. In view of above, no interference is required. However, it is open to the petitioner to approach the authorities concerned for redressal of his grievance. With the aforesaid observation, the writ petition is disposed off. Order Date :- 26.10.2023 Rahul. High Court of Judicature at Allahabad
