¶1By means of this petition filed under Article 226 of the Constitution of India the petitioner has prayed for following reliefs as substantial relief: "A. Issue a writ order or direction in the nature of mandamus commanding to the respondents to release the salary of the present petitioner of the medical leave from 25.02.2021 to 19.05.2021. B. Issue a writ, order or direction in the nature of Mandamus commanding and directing the respondents to decide the representation of the petitioner dated 26.07.2023."

¶2Learned counsel for the petitioner submits that he has attained the age of superannuation on 30.04.2023 but has not been paid salary for the period he was on medical leave. In the said regard he has already made a representation before the competent authority on 26.07.2023.

¶3Learned Standing Counsel does not have any objection to the above prayer.

¶4In view of the above, this petition stands disposed of with direction to the respondent no.3, namely, Sub Divisional Magistrate, Tehsil Khaga, District Fatehpur to look into and consider the claim of the petitioner as raised in his representation dated 26.07.2023 and decide the same as expeditiously as possible preferably within a period of three months from the date of production of certified copy of this order.
