Learned counsel for the petitioner submitted that without recovering the money from the main borrower, the guarantor i.e. the petitioner, was asked to clear the debt and in pursuance thereof an illegal recovery certificate had been issued against the petitioner. Sri Krishna Mohan Asthana, learned counsel for the Bank has stated that the matter was being settled as per the document dated
01.02.2023. He has stated that even though earlier a date
11.02.2023 was fixed before Lok Adalat, settlement had not been arrived and therefore, a further date had been fixed. He further submits that if that is the case, the petitioner may also file his objection before the District Legal Service Tribunal, Aligarh where the Rashtriya Lok Adalat was being held. Under such circumstances, we refrain from interfering in the writ petition. It is always open for the petitioner to file an objection before the Rashtriya Lok Adalat in the District Legal Service Tribunal, Aligarh. In view of the above, this writ petition is disposed of.
