This writ petition has been filed challenging the order passed under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. Learned counsel for the Bank has stated that yet no auction has been done of the property and that if the petitioner approaches the Bank for depositing the entire amount which was due to the Bank then the Bank would consider the prayer of the petitioner. Learned counsel for the Bank states that no installment be fixed as earlier by means of a writ petition being Writ C No. 28681 of 2021 (M/s. Virangana Uda Devi Trading Company vs. State of U.P. and 3 others) the petitioner had approached this Court and the Court had fixed the installments, the payment of which was defaulted by the petitioner. Under such circumstances, we are also refraining from fixing any installments. However, if the petitioner approaches the Bank and requests for depositing the entire amount in one go, the Bank would consider the prayer of the petitioner sympathetically.
