¶1Heard Mr. Gyanu Shukla, learned counsel for the applicant and learned Additional Government Advocate for the State.

¶2This anticipatory bail application (under section 438 Cr.P.C.) has been moved seeking bail in Case Crime No.608 of 2017, under Sections 147, 427, 436, 452, 504 and 506 IPC, Police Station Kasya, District Kushinagar.

¶3Learned counsel for the applicant is claiming parity of co-accused persons, namely, Upendra, Shambhu and another, who have been granted regular bail by this Court vide order dated

07.01.2020 passed in Criminal Misc. Bail Application Nos.227 and 363 of 2020, copy of bail order has been annexed as Annexure No.1 to the supplementary affidavit.

¶4Considering the facts and circumstances of the case, the present application is disposed of provided that in case the applicant appears and surrenders before the court below and apply for regular bail, the same shall be decided in accordance with law.
