At the very outset Sri Krishna Nand Yadav, learned counsel for the writ petitioner seeks to withdraw the writ petition preferred by him seeking mandamus to the third respondent, Additional Director of Secondary Education Directorate Prayagraj U.P. to regularise the services of the writ petitioner as Assistant Teacher (Physical Training) in view of the provisions contained under Section 33-G of the U.P. Act No. 5 of 1982 as according to him the writ petition is not properly constituted with liberty to file fresh. Learned Standing Counsel has no objection to the same.
