¶1Learned counsel for the applicant prays for and is permitted to make necessary correction in the prayer clause of this application, during the course of the day.

¶2Heard learned counsel for the applicant, learned AGA for the State and perused the record.

¶3This application under Section 482 CrPC has been filed with the prayer to direct the Civil Judge (Sr. Div.), Gorakhpur to decide the Complaint Case No. 1224 of 2022 (Shrya Verma Vs. Dr. Kumar Rahul and Others), under Section 12 of Protection of Women from Domestic Violence Act, Police Station Shahpur, District Gorakhpur within stipulated period.

¶4Learned counsel for the applicant has submitted that applicant is the wife of opposite party no.2 and she had filed an application under Section 12 of Protection of Women from Domestic Violence Act against her husband on

10.01.2023, on the basis of which, the instant complaint case has been instituted, however, the same has not yet been disposed of and the proceedings has been lingering-on on one pretext or the other.

¶5In view of the above, learned court below is expected to make all endeavours to decide the aforesaid complaint case as expeditiously as possible, preferably within a period of four months from the date of filing of a certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid complaint case.
