Hon'ble Sanjay Kumar Pachori,J. Sri Ram Asrey Yadav, learned counsel for the applicants and Sri Moti Lal, learned A.G.A. for the State are present. The present transfer application has been filed to transfer the S.T. No. 430 of 1999 arising out of Case Crime No. 29 of 1997, under Section 323, 504 and 304 IPC, pending in the court of Additional Sessions Judge, Court No.6, Varanasi to any competent court of Chandauli Judgeship. Learned counsel for the applicant submits that the applicants are accused in the above noted session trial. It is further submitted after formation of new district Chandauli jurisdiction has been transferred to district Chandauli and the witnesses are resident of district Chandauli. Learned counsel for the applicants fairly admits that one prosecution witness has been examined. In view of the above facts and circumstances of the case, this transfer application has no merit and deserves to be dismissed. Accordingly, this transfer application is dismissed.
