Court No. - 34 Case :- WRIT - A No. - 17887 of 2023 Petitioner :- Ashok Kumar Sharma And 2 Others Respondent :- State of U.P. and Another Counsel for Petitioner :- Gulab Chandra Tiwari,Alok Tripathi Counsel for Respondent :- C.S.C.,Saurabh Tiwari Hon'ble Ajit Kumar,J.

¶1Heard learned counsel for the parties.

¶2By means of this petition, petitioners have prayed following relief(s): "I. a writ, order or direction in the nature of mandamus directing the respondents to pay gratuity, provident fund with interest in representations dated 05.12.2016 as well as 04.07.2023."

¶3Learned Advocate appearing for the respondent, Sri Saurabh Tiwari submits that petitioner is still in service and, therefore, cannot claim post retirement benefits like gratuity provident fund etc. The relief claimed is premature.

¶4On the pointed query being made, learned counsel for the petitioner could not dispute the fact that petitioner is still in service.

¶5In view of the above, I do not find any good ground to entertain this petition at this stage.

¶6Petition is, accordingly, dismissed at this stage. Consigned to records. Order Date :- 26.10.2023 P Kesari High Court of Judicature at Allahabad
