¶1Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

¶2This application under Section 482 Cr.P.C. has been filed seeking direction to the court below to decide the proceedings of Criminal Case No.3944 of 2020 (State Vs. Vivek pandey and Another) arising out of Case Crime No. 357 of 2019, under Sections 498-A, 323, 504, 506 I.P.C, P.S. Cholapur, District Varanasi.

¶3Counsel for the applicant submits that applicant is informant and lodged F.I.R. against the opposite party nos. 2 and 3. The Investigating Officer submitted charge sheet on 25.02.2020 and learned Magistrate has taken cognizance but till today, no charge has been framed. The case is pending before the trial court since 2019.

¶4Considering the aforesaid facts, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of three months from the date of production of a certified copy of this order, if there is no other legal impediment.
