The first bail application of the applicant was dismissed by this Court vide order dated 20.01.2023 passed in Criminal Misc. Bail Application No. 58791 of 2022 and he is pressing the instant second bail application on the ground that when injured i.e. PW-1 appeared before the trial court then he did not state anything against the applicant. He produced the certified copy of the statement of injured PW-1, which has already taken on record and has already marked as 'A'. He next submits that applicant was not having any previous criminal history and in the present matter he is in jail since 20.09.2022 i.e. for more than one year.

¶6I have heard learned counsel for the parties and perused the record of the case.

¶7Although, this is second bail application filed on behalf of the applicant and his first bail application was dismissed by this Court on merit vide order dated 20.01.2023 passed in Criminal Misc. ¶8Further, applicant is not having any previous criminal history and in the present matter he is in jail since 20.09.2022 i.e. for more than one year.

¶9Therefore, considering the facts and circumstances of the case discussed above, in my view, applicant is entitled to be released on bail.

¶10Accordingly, without expressing any opinion on the merits of the case, the instant second bail application is allowed.
