¶1None appeared on behalf of the applicant even in revised call.

¶2Sri S.B. Singh, learned A.G.A. is present.

¶3On 09.10.2023, C.J.M. concerned was directed to provide current status of the trial.

¶4As per office report dated 26.10.2023, a report from the concerned court has been received.

¶5However, from perusal of the report dated 25.10.2023 of District and Sessions Judge, Court No.4, Kanpur Dehat, it reflects that during pendency of his appeal, applicant has been released on bail by this Court but from the report, it is not clear whether trial of the case has concluded or not.

¶6At this stage, Sri S.B. Singh, learned A.G.A. submits that trial of the case has already been concluded and applicant has been convicted and after his conviction, he has filed an appeal before this Court being Criminal Appeal No,. 8079 of 2022 and during pendency of the same, applicant has been released on bail vide order dated 21.09.2023. Therefore, the instant bail application has become infructuous and the same may be dismissed as infructuous.
