Court No. - 6 Case :- WRIT - C No. - 33224 of 2023 Petitioner :- Smt. Gudiya Devi Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Gaurav Kumar Shukla,Shailendra Kumar Pandey Counsel for Respondent :- C.S.C.,Pankaj Kumar Gupta Hon'ble Mrs. Manju Rani Chauhan,J. Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondent, learned counsel for respondent no. 5 and perused the record. The writ petition has been filed with a prayer to quash the impugned order dated 21.07.2023 passed by respondent no. 3 against the petitioner and further prayed to not to allot the fair price shop in question in terms of the impugned order dated

21.07.2023. Learned counsel for the petitioner submits that the fair price shop in question was originally allotted to one Shiv Prasad son of Ram Dev, belonging to Other Backward Class Category, but now the same is going to be allotted to the person belonging to some other category, i.e. Scheduled Caste Category, in violation of the government order, therefore, the petitioner moved a representation before the authorities concerned, which has been rejected by the order impugned. Learned counsel for the petitioner further submits that the representation has been rejected in a mechanical manner. Learned Standing Counsel for the State-respondent and learned counsel for respondent no. 5 submits that no such notification has been issued till date to show that the fair price shop has to be allotted according to the category of the village pradhan, therefore, the present writ petition has been filed misinterpreting the government order. The writ petition is wholly misconceived and is accordingly, rejected. Order Date :- 26.10.2023 Arti High Court of Judicature at Allahabad
