CAPL 7811/2023

Judgment

Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 7811 of 2023 Applicant :- Raja Mishra Opposite Party :- Vinay Singh, The City Magistrate Counsel for Applicant :- Shantanu Hon'ble Rohit Ranjan Agarwal,J. Heard learned counsel for the applicant. Perused the order dated 11.11.2010 passed in Writ-C No.66314 of 2010, which is as under:- "The petitioner has contended that he is Rajkiya Panda of the temple of Maa Vindhyavasini, Vindhyachal, District Mirzapur. He wanted informations from the District Magistrate about the movement of the VIP's so that he can accommodate them in connection with Pooja and Archana etc. According to him the Sub Divisional Magistrate has forwarded a letter to the City Magistrate because he is the Secretary of the Vindhya Vikas Parishad. Against this background we find that the petitioner is claiming customary privilege and not any legal right. If this is the practice that he is accommodating the movement of VIP's in the Mandir and if any exigency arises it is open for the District Magistrate to apply his discretion to maintain the law and order and also to see comfort of such visitors and being so if the District Magistrate, City Magistrate or Sub Divisional Magistrate call upon the petitioner he will discharge the duty or even attend to the pilgrims, whether they are VIP or otherwise, without any hindrance except in accordance with law and subject to all such valid restrictions to maintain law and order. It goes without saying that the other similarly placed persons shall not in any manner be affected by this order. With the above observation the writ petition is disposed of. No order is passed as to costs." From the perusal of the aforesaid order, no case for contempt is made out. Contempt application is misconceived and the same stands dismissed.
