Hon'ble Syed Aftab Husain Rizvi,J. Learned counsel for the petitioner submitted that he does not want to press this petition, as he wants to avail the remedy of appeal. Learned counsel further submitted that as limitation of time for appeal has expired, direction be issued to entertain the appeal taking in view the proceeding pursued here. The learned AGA has no objection. In view of the above statement, the petition is dismissed as not pressed with liberty to avail the appropriate remedy by the petitioner. It is made clear that if any appeal is filed, time spent herein in this proceeding, shall be taken into consideration for counting the period of limitation.
