¶1Heard Mr. Krishna Kumar Mishra, learned counsel for the petitioner, Mr. Atul Kumar Srivastava, learned Standing Counsel for the State respondents and Mr. Bhupnedra Kumar Tripathi, learned counsel appearing for the respondent no.18, Gram Panchayat.

¶2The instant petition has been filed for mandamus directing the respondent no.3/ U.P. Ziladhikari, Tehsil-Mariyahun, District-Jaunpur, to decide the Case No. T201814360602038 (Kalawati vs. Lolaraknath) under Section 144 of U.P. Revenue Code,2006, within a stipulated period.

¶3Learned counsel for the petitioner submits that the aforementioned suit for declaration filed at the instance of the petitioner is pending before respondent no.3 even after expiry of more than five years.

¶4Copy of the order sheet has been annexed as Annexure No. 2 to the writ petition in order to demonstrate that the case is not proceeding expeditiously.

¶5Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of directing the respondent no.3 to conclude the proceedings of the aforementioned case in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
