Judgment

Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 5371 of 2022 Applicant :- Bhagwan Das Sahu Alias B.D. Sahu Opposite Party :- Anil Kumar, Managing Director(Urban) And 2 Others Counsel for Applicant :- Kamlesh Kumar Tiwari Counsel for Opposite Party :- Vimlesh Kumar Rai Hon'ble Rohit Ranjan Agarwal,J. The writ Court while deciding writ petition on 08.10.2021 had required the opposite party to decide the claim of the applicant. A compliance affidavit has been filed wherein it has been stated that order has been passed and entire retiral dues has been paid to the applicant on 22.10.2022. Copy of the said order has been annexed as Annexure-1 to compliance affidavit. Learned counsel for the applicant states that interest has not been paid to the applicant as decided in the matter of Yogendra Singh vs. State of U.P. [(2017) 1 ALJ 121]. This Court finds that substantial compliance has been done by opposite party and only direction was there to decide claim of the applicant which the authorities have done. In view of said fact, contempt application stands dismissed. However, if any dues remains, the applicant may approach appropriate forum, if so advised.
