¶1Heard Sri Suresh Kumar Gupta, learned counsel for petitioner and learned Standing counsel for State respondents.

¶2Present petition has been filed seeking following reliefs: "I) Issue a writ, order or direction in the nature of mandamus directing the respondents not to dispossess the petitioner from his house situated at village Saina, Jaunra, Police Station Month District Jhansi in arazi no. 377 have its old number as 773/2 without due process of law;"

¶3It is the case of the petitioner that on the basis of complaint made by respondent no. 5, revenue authorities are threatening petitioner to demolish his house situated over plot no. 377 which is recorded as banjar land in the revenue records.

¶4The entire averments made in the petition is only on the basis of conjecture and surmises and the presumption whatsoever has been drawn by the petitioner for preferring the instant writ petition and no order has been preferred or appended along with the petition which is not sustainable in the eye of law.

¶5In view of the aforementioned facts and circumstances, no cause of action survives in favour of the petitioner to pursue the instant petition and the same stands dismissed. Order Date :- 27.10.2023 Shaswat High Court of Judicature at Allahabad
