¶1The writ Court on 09.11.2017 while disposing of Writ - C No.52275 of 2017 had passed the following order : "Heard the learned counsel for the parties. The petitioner executed the work as per the agreement and presented a bill, which has not been cleared till date. In the regard, the petitioner has made a representation before the authority, which is pending consideration. In the light of the aforesaid, we dispose of the matter directing the respondent no. 3 to decide the petitioner's representation by a reasoned and speaking order within six weeks from the date of production of a certified copy of this order."
¶2From perusal of the order it is clear that only a direction was issued to the opposite party to decide representation of the applicant by reasoned and speaking order. The opposite party on
25.11.2017 had decided the representation, a copy of which has already been brought on record as Annexure 6 to the affidavit filed in support of contempt application.
¶3As the order of the writ Court has been complied with, the contempt application has rendered infructuous and stands dismissed.
¶4Contempt notice stands discharged.
¶5However, it is open to the applicant to assail the order passed by opposite party before the appropriate Forum, if so advised. Order Date :- 27.10.2023 Kushal High Court of Judicature at Allahabad
