Heard learned counsel for the petitioner. The petitioner is the decree-holder in Original Suit No.235 of 2002. Execution proceedings were instituted by him, being Execution Case No.10 of 2004, which proceedings are stated to be pending since 2004 in the court of the Civil Judge (Senior Division), Court No.18, Deoria. A direction for disposal of the aforesaid execution case has been sought in this petition. When the matter was listed on 06.10.2023, another Bench of this Court had directed a report to be summoned from the District Judge, Deoria. On record is the report dated 16.10.2023 of the District Judge, on perusal of which it is reflected that due to pendency of Misc. Case No.50 of 2015 in the aforesaid Execution Case No.10 of 2004, the case is held up. The District Judge has directed the Judicial Officer concerned to dispose of the matter expeditiously. Under the circumstances, since a direction has already been issued by the District Judge to the Judicial Officer concerned, no further direction is required to be issued.
