Judgment

Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 6222 of 2023 Applicant :- Kamaruddin Opposite Party :- Awdesh Kumar Sharma Project Manager M/S U.P. Project And Tubewell Corporation Ltd. Counsel for Applicant :- Dharmendra Dhar Dubey Hon'ble Rohit Ranjan Agarwal,J. Heard learned counsel for the applicant and Sri Rakesh Pande, learned Senior Advocate appearing for U.P. Project and Tubewell Corporation Ltd. This contempt application has been filed for punishing the opposite party for not complying the order dated 24.04.2023 passed by writ Court. The facts of the case are that the dispute was referred to Industrial Tribunal and an award was made on 18.11.2002 in Adjudication Case No. 136 of 2000. The award was challenged through Writ-C No. 45839 of 2003 before this Court by U.P. Project and Tubewell Corporation Ltd. The writ petition was dismissed on 24.04.2023. Learned counsel for the applicant has submitted that despite dismissal of the writ petition, the award is not being executed and given effect to. This Court after hearing learned counsel for the parties finds that remedy lies before the Industrial Tribunal by filing execution case and not by filing contempt application before this Court. The applicant has remedy under U.P. Industrial Disputes Act. The contempt application is misconceived and stands dismissed. Order Date :- 27.10.2023 V.S.Singh High Court of Judicature at Allahabad
