¶1Heard learned counsel for the appellant.
¶2The present appeal has been filed by appellant-UPSRTC challenging the award dated 23.04.1996 passed by Motor Accident Claims Tribunal/Xth Additional District Judge, Aligarh in M.A.C. No.129/1989.
¶3Challenging the award, learned counsel for the appellant has contended that the compensation of Rs.2,36,500/- awarded by the tribunal to the claimant-respondent for the injuries suffered by her in the accident is excessive. It is submitted that in such view of the fact, the tribunal should have reduced the compensation.
¶4Be that as it may, the Apex Court in the case of Pappu Deo Yadav Vs. Naresh Kumar & Others AIR 2020 SC 4424 has held that even in case of injury, claimant is entitled to future prospect.
¶5In the instant case, the tribunal has not awarded any amount towards future prospect. In such view of the fact, this Court is not inclined to interfere with the quantification of award.
¶6Consequently, the appeal lacks merit and is dismissed. Order Date :- 27.10.2023 SS High Court of Judicature at Allahabad
