¶1Heard Shri Umesh Kumar Pal, learned counsel for the petitioner.

¶2This petition has been filed by the defendant seeking the following relief: "(a). Direct the court below to decide the Civil Suit No. 671 of 2022 alongwith 6-C application dated 24.02.2022, (Sudheer Gupta Vs. Harishankar Singh and another), pending before Civil Judge (Junior Division), Court No.10, Deoria within stipulated period as directed by this Hon'ble Court (Annexure no.1)."

¶3It appears that a suit for permanent injunction was filed by the plaintiff-respondent no. 2 in which, as it appears from the order-sheet, an application 6C was filed seeking temporary injunction. However, notices were issued on that application which is yet not being decided. In the order-sheet on 10.5.2023 it was recorded that the officer is on leave.

¶4Be that as it may, the trial court is requested to endeavour to consider the application 6C in accordance with law without granting any unnecessary adjournment to either of the parties after ensuring that the defendants are duly served and provided there is no legal impediment.
