¶1Heard Shri Shrawan Dwivedi, learned counsel for the petitioner.

¶2This petition has been filed with the following prayer: "i) direct the Civil Judge, Senior Division/ Haveli, Azamgarh/ Competent Civil Court to decide the Case No.1219 of 2013 (Sriram Yadav Versus Mishri) pending in the Court of Civil Judge, Senior Division/ Haveli, Azamgarh Competent Civil Court, within fixed period as fixed by this Hon'ble Court.

ii) To direct the Civil Judge, Senior Division/ Haveli, Azamgarh/ Competent Civil Court to decide the 6C application filed in aforesaid suit during the pendency of final disposal of the Case No.1219 of 2013 (Sriram Yadav Versus Mishri)."

¶3It appears that a suit was filed by the petitioner seeking a decree of permanent injunction . It is stated that by order dated 25.4.2022, the trial court has directed the case to proceed ex-parte and the case is being listed for ex-parte evidence.

¶4Under the facts and circumstances, the relief as sought for in this petition is declined. However, it is expected that the trial court would proceed with the matter without granting any unnecessary adjournment to either of the parties.
