Judgment
Court No. - 39 Case :- WRIT - C No. - 36794 of 2023 Petitioner :- Supriya Industries Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Gaurav Gupta Counsel for Respondent :- C.S.C,Anuj Pratap Singh Hon'ble Saumitra Dayal Singh,J. Hon'ble Surendra Singh-I,J.
¶1Heard Sri Gaurav Gupta, learned counsel for the petitioner, Ms. Stuti Agarwal, learned counsel for the respondent nos. 2 and 3 and Sri Chandrashekhar Singh, learned counsel for the respondent no. 1.
¶2The petitioner claims direction upon the respondent no. 2 to decide the representation dated 09.09.2022 essentially seeking re-allotment of plot no. E-22.
¶3Undisputedly, the above plot was earlier allotted in favour of the petitioner and agreement had been executed on 03.05.2002. That agreement was cancelled on 28.06.2008. The petitioner raised a belated challenge to the cancellation by means of WRIT-C No. 6340 of 2018, Supriya Industries Vs. State of U.P. and 2 others. That was dismissed by order dated 16.02.2018 on the ground of latches.
¶4In the above facts, we find no subsisting rights with the petitioner to seek re-allotment of this plot.
¶5In the absence of any legal right existing, the mandamus prayed for is misconceived. It is declined.
¶6Accordingly, the writ petition is dismissed.
¶7It is however left open to the petitioner to apply afresh for allotment of the plot in question, if and when applications are invited for the same, by the respondents. Order Date :- 27.10.2023 KS (Surendra Singh-I,J.) (Saumitra Dayal Singh,J.) High Court of Judicature at Allahabad
