1.Heard Mr. Mahaveer Yadav, holding brief of Mr. Najakat Ali, learned counsel for the petitioner and Mr. R. C. Srivastava, learned Additional Chief Standing Counsel for the State-respondents.

2.The instant writ petition has been filed for the following relief: "(i) issue a writ, order or direction in the nature of writ mandamus commanding and directing the respondent Nos.2, 3 and 4 not to make interference in the peaceful possession of the petitioner over the house in question and further direct the respondent No.2 District Magistrate,

to

decide

the representation/application of the petitioner dated 30.05.2023 pending before him expeditiously within stipulated period to be fixed by this Hon'ble Court."

¶3On 13.10.2023 following order was passed by this Court: "1. Short reply to the instruction, filed on behalf of the petitioner is taken on record.

¶2Learned counsel for the petitioner on the basis of reply to the instruction dated 13.10.2023 submitted that there is no encroachment by the petitioner over the passage, as such, the demolition of the petitioner's construction is illegal.

¶3On the other hand, Mr. O.P. Sharma, learned Additional Chief Standing Counsel for the State-respondents submitted that in the spot map, the passage has been shown over which the pillar has been constructed by the petitioner, as such, the same has been demolished and no demolition of the residential construction has been made by the State.

¶4In the instruction served to the counsel for the petitioner, the copy of the spot memo has not been annexed.

¶5Learned Additional Chief Standing Counsel for the State-respondents is directed to serve the copy of the spot map also which is annexed in the instruction dated 13.10.2023 supplied to the Court on 18.9.2023.

¶6Learned counsel for the petitioner shall file further reply taking into consideration the spot memo annexed along with the instruction.

¶4In compliance of the earlier order of this Court, petitioner has filed reply to the instruction submitted by learned Additional Chief Standing Counsel, which is taken on record.

¶5Learned counsel for the petitioner submitted that construction was raised in the abadi area and there is no encroachment of village pathway in any manner. He further submitted that authorities have illegally demolished the part of the construction belonging to the petitioner without following due procedure of law. He further submitted that authorities be directed to reconstruct the demolished portion of the construction belonging to the petitioner.

¶6On the other hand, Mr. R.C. Srivastava, leaned Additional Chief Standing Counsel for the State-respondents submitted that petitioner's house has not been demolished in any manner rather the pillars which were fixed by the petitioner in the village pathway has been demolished. He further placed the spot map of the plot in question in order to demonstrate that pillars which were fixed in the village pathway, has made the village pathway conjusted .

¶7I have considered the arguments advanced by the learned counsel for the parties and perused the record.

¶8The instruction send by District Magistrate, Rampur is relevant for perusal which is as under: ""

¶9The copy of the spot map is also annexed along with the instruction in support of the averment made in the instruction which fully demonstrate that pillars constructed by the petitioner has made the village pathway conjusted.

¶10Considering the averment made in the instruction, as well as spot map annexed along with the instruction, no interference is required in the matter as only the pillars which has narrowed down the village pathway has been demolished and there is no demolition of the petitioner's residential house in any manner.
