After arguing the matter at some length, Sri Akhilesh Tripathi, learned counsel for the appellant states that he may be permitted to withdraw the present appeal with liberty to file the recall application before the learned court below while Sri Ajay Kumar Singh, learned counsel appearing for the respondent would contend that no appeal lies as the order impugned is a consented and he has right to object to the recall application that may be filed.
