And 6 Others Counsel for Petitioner :- Atipriya Gautam,Devesh Mishra,Harsh Kumar Anand,Sr. Advocate Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Ms. Nand Prabha Shukla,J.

¶1Heard Shri Harsh Kumar Anand, learned counsel for the petitioner and Shri F.A. Ansari, learned Standing Counsel.

¶2The petitioner, who is a retired Inspector General of Police, has approached this Court for a direction to the respondent authorities, to provide adequate high level security permanently, in the form of Armed Police Personnel (Gunners) for the safety and security of life and the property of the petitioner on the full expenditure of the State Government.

¶3It is contended that during the service period the petitioner had always been trying to curb/ control the anti-social elements and as such he has always been the major target of such anti-social elements. During service period, he has been provided adequate security but after retirement no such security is available with him and as such there is grave threat to his life and property. In this regard he has made several representations, but no action has been taken by the respondents and as such this Court may come for rescue and reprieve of the petitioner.

¶4Learned counsel for the petitioner has submitted that similar controversy has earlier been raised before this Court in Writ-C No.19981 of 2023 (Ashish Sharma v. State of U.P. & Ors.). The said writ petition was disposed of on 12.7.2023 giving positive direction. As such it is submitted that similar direction may also be passed in this writ petition also.

¶5Considering the facts and circumstances of the case, present writ petition is disposed of with liberty to the petitioner to move a fresh application before the District Level Security Committee headed by the District Magistrate as per the relevant Government Orders within two weeks from today and in case any such application is moved by the petitioner, definitely the same would be considered and decided strictly in accordance with law, as well as in the light of relevant Government Orders within six weeks, thereafter.
