Vide order dated 12.10.2023, Shri Saurabh Chaturvedi, learned Amicus Curiae is directed to file an application under Section 389(1) of the Code of Criminal Procedure for suspending the sentence of appellant-Jahendra Singh annexing the custody certificate. When the case is taken up today, Shri Saurabh Chaturvedi, learned Amicus Curiae submits that he has received a communication from the Superintendent of District Jail, Lalitpur dated 22.10.2023 informing that the appellant-Jahendra Singh died while incarceration on 6.6.2021 at the District Hospital, Lalitpur. The appellant-Jahendra Singh was in jail pursuant to the conviction order and judgment dated 10.5.2016 passed by the Additional District and Sessions Judge, F.T.C.-IInd, whereby he was awarded the sentence of life imprisonment and is facing incarceration, but he was died on 6.6.2021. In addition to this, the Superintendent of District Jail, Lalitpur has also annexed the post-mortem report of the deceased-Jahendra Singh, which indicates that no mark of external injury was seen over the body and the cause of death of the deceased was Intracranial hemorrhage.
