¶1Heard Sri Khurshed Alam, learned counsel for the petitioner and Sri Prabhakar Tripathi, learned Standing counsel appearing on behalf of respondent nos. 1 to 3 as well as Sri Sudhir Bharti, learned counsel for respondent no. 8.

¶2Present petition has been filed seeking a direction in the nature of mandamus to be issued in favour of the respondent no.3 to remove the illegal encroachment made over the public utility land bearing plot nos.576, 586 and 589M situated at Village Sarhasbah, Tehsil Rudrapur, District Deoria.

¶3Today when the matter has been taken up, learned counsel for Gram Sabha came up with the specific instructions which is taken on record through which it has been transpired that proceedings under Section 67 of U.P. Revenue Code, 2006 has already been initiated against respondent nos.4 to 6.

¶4Accordingly, the present petition stands disposed of with the best of hope that respondent no.3 shall expedite the proceedings under Section 67 of U.P. Revenue Code, 2006 as early as possible without granting any unnecessary adjournment to the alleged encroachers and after providing due opportunity of hearing to all the concerned.
