(1) Heard learned counsel for the petitioner, Sri Piyush Dubey, learned counsel for the respondent no.3 and learned A.G.A. for the State.

(2) Contention of the learned counsel for the petitioner is that petitioner no.2, the alleged victim, is residing with the petitioner no.1 out of her own freewill. She has a right to do so being major.

(3) In view of above submission, it is provided that the petitioner no.2-Kashish shall appear before the concerned Magistrate on 9th November, 2023 where her statement under Section 164 Cr.P.C. shall be recorded.

(4) This statement shall also made available to the Investigating Officer, who shall thereafter proceed strictly in accordance with law.
