¶1Supplementary affidavit preferred today by learned counsel for the petitioner is taken on record.

¶2Heard Sri Vinod Kumar Tiwari, learned counsel for the petitioner and Sri Prabhakar Tripathi, learned Standing counsel appearing on behalf of respondent nos. 1 to 4 as well as Sri Azad Rai, learned counsel for respondent no. 5.

¶3Present petition has been filed seeking a direction in the nature of mandamus to be issued in favour of the respondents to remove the illegal encroachment made over plot nos.352, 354, 368 and 377 which are recorded as chakmarg in the revenue record, situated at Village Mungrav, Tehsil Handia, District Prayagraj.

¶4Today when the matter has been taken up, learned Standing Counsel came up with the specific instructions which is taken on record through which it has been transpired that no encroachment has ever been carried out by anyone over the aforesaid plots.

¶5In view thereof, there is hardly any cause of action arises in favour of the petitioner to pursue the instant petition.
