¶1The claim of the petitioners in the present petition is that they are entitled to be included in the package for rehabilitation and resettlement because they are land oustees of Kanhar Dam Project, Duddhi Sonbhadra as stipulated in the Government Order dated

30.10.2014.

¶2It is stated that the petitioners are being illegally denied benefits of paragraph no. 4 (v) of the Government Order dated 30.10.2014.

¶3It would serve no useful purpose to keep the petition pending and considering the pleadings in the petition and the circumstances of the case, the petition is disposed of with the direction to the District Magistrate, Sonbhadra/Administrator/Kanhar Dam Project, Sonbhadra that in case the petitioners file a fresh representation before the District Magistrate, Sonbhadra within one month from today, the same shall be decided by him within a period of three months from the date of filing of such representation and appropriate action in accordance with law shall be taken depending upon the decision of the District Magistrate, Sonbhadra within next period of one month.
