Judgment
Court No. - 47 Case :- WRIT - C No. - 33156 of 2023 Petitioner :- Vanabari Lal Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Rati Bhan Singh Counsel for Respondent :- C.S.C. Hon'ble Manish Kumar Nigam,J.
¶1Heard learned counsel for the petitioner, learned Standing Counsel for the State and perused the record.
¶2The instant writ petition has been filed for following relief: "(i) A writ, order or direction in the nature of mandamus direction the Sub Divisional Magistrate, Tehsil-Kheragarh, District-Agra (Respondent No.-3) to decide the representation dated 11.07.2023 Annexure No. 4 to the accompanying Writ Petition filed by the petitioner before him expeditiously within a short period as stipulated by this Hon'ble Court in accordance with law."
¶3From the perusal of the representation filed as annexure no. 4 to this writ petition, it appears that petitioner has dispute with a private person.
¶4Learned Standing Counsel raised a preliminary objection that such a writ petition is not maintainable for a private dispute and in the garb of the present petition the petitioner wants to settle his private dispute and he has not impleaded the person against whom the representation is made by the petitioner.
¶5In view of the above, I am not inclined to interfere in the matter.
¶6Accordingly, the petition is dismissed with liberty to the petitioner to seek relief as available to him under provisions of U.P. Revenue Code, 2006. Order Date :- 28.10.2023 Ved Prakash (Manish Kumar Nigam, J.) High Court of Judicature at Allahabad
