Court No. - 34 Case :- WRIT - A No. - 18096 of 2023 Petitioner :- Brijendra Kumar Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Siddharth Khare,Sr. Advocate Counsel for Respondent :- CSC Hon'ble Ajit Kumar,J. Petitioner, who is working as a Gram Panchayat Vikas Adhikari was placed under suspension on 1st September, 2022 and disciplinary proceedings got instituted with issuance of notice on 13th September, 2022. Petitioner did submit reply on 27th September, 2022, however, nothing further progressed in the matter of departmental inquiry and ultimately petitioner was reinstated provisionally revoking the suspension order on 2nd November, 2022. Petitioner is aggrieved due to the long pendency of disciplinary proceedings as he has stood superseded by the subsequent promotion made by the authorities. Accordingly, he prays that departmental inquiry proceedings should be directed to be concluded within a specific period of time. Learned Standing Counsel does not have any objection to the above request. In view of the above, this petition stands disposed of with a direction that departmental inquiry shall be concluded within a period of one month from the date of production of certified copy of this order with due participation of the petitioner and, thereafter disciplinary proceedings, if any, may be concluded within a further period of two months. Needless to add, the procedure prescribed for holding departmental inquiry and disciplinary proceedings shall be religiously adhered to.
