This second bail application has been filed on behalf of applicant in Case Crime No. 12 of 2023, under Sections 420, 379, 411 I.P.C., Police Station Lalpur/Pandeypur, District Varanasi with the prayer to enlarge the applicant on bail. The first bail application of the applicant has been rejected by this Court vide order dated

12.06.2023. It has been argued by learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. 02.12.2022 from the A.T.M. of the informant but no complaint was made to the bank or any authority. It is also submitted that no golden ring was recovered from the possession of the applicant. Considering the entire facts and circumstances of the case, submissions of learned counsel for the parties, nature of evidence and all attending facts and circumstances of the case, without expressing any opinion on merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed.
