Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 7915 of 2023 Applicant :- Shyam Narayan Maurya Opposite Party :- Shri S Rajalingam, D.M. And Another Counsel for Applicant :- Arvind Kumar Rai Hon'ble Rohit Ranjan Agarwal,J. The writ Court on 02.02.2023 in Writ-C No.2930 of 2023 had passed the following order:- "It is submitted by learned counsel for the petitioner that the chak road has been encroached upon by the private respondents. Learned Standing Counsel submits that the petitioner has a remedy under section 26 of the U.P. Revenue Code, 2006 to approach the Tehsildar in this respect. At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw the present writ petition with liberty to approach the authorities concerned under the U.P. Revenue Code, 2006. Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioner to approach the authority concerned under the U.P. Revenue Code, 2006. In case any such application is filed for removal of obstacles from the chak roard, the same shall be considered and decided by the respondent authorities in accordance with law in a time bound manner." From the perusal of the aforesaid order, it is clear that the writ petition was dismissed as withdrawn. As the writ petition was itself dismissed as withdrawn, present contempt application is misconceived and the same stands dismissed.
