The instant application has been filed u/s 482 Cr.P.C. for directing the Additional District and Sessions Judge, Court No. 11, Moradabad to decide the Sessions Trial No. 757 of 2022 (State vs .Sukhvir), arising out of Crime No. 0339 of 2021, u/s 306, 506 I.P.C. and 67A I.T. Act, P.S. Pakbara, District Moradabad, pending before him. Contention of counsel for the applicant is that PW-1 was recorded on 2.11.2022 and since then none of the witnesses has turned up before the court below and the court below is granting routine adjournment despite the fact that the applicant is in jail since 2021. Considering the aforesaid submission, Additional District and Sessions Judge, Court No. 11, Moradabadis directed to decide the Sessions Trial No. 757 of 2022 (State vs .Sukhvir), arising out of Crime No. 0339 of 2021, u/s 306, 506 I.P.C. and 67A I.T. Act, P.S. Pakbara, District Moradabad, expeditiously preferably within a period of one year from the date of production of copy of this order.
