This writ petition has been filed against the sale notice of immovable property dated 5.9.2023. Learned counsel for petitioner submits that in view of the law laid down in the case of CELIR LLP Vs. Bafna Motors (Mumbai) Pvt. Ltd. and others decided on 21.9.2023 in Civil Appeal Nos.5542-43 of 2023, the writ petition be dismissed as withdrawn and the petitioner be given a liberty to take such action as might be available under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The writ petition is accordingly dismissed as withdrawn with liberty as prayed. This order was passed in the presence of Sri Gyan Prakash Srivastava, learned counsel for respondent bank.
