Heard Sri Siddharth Nandan, learned counsel for the petitioners and Sri Rahul Sahai, who has put in appearance on behalf of the respondents by filing his Vakalatnama in Court today. Counsel appearing for the respondents points out that against the order dated 25.08.2023, passed by Civil Judge (Senior Division), Budaun in S.C.C. Suit No. 2100002 of 2012, the petitioners would have the remedy of a statutory revision and in view thereof the present petition would not be entertainable. Counsel for the petitioners has not disputed the factum with regard to existence of the statutory alternative remedy. Accordingly, learned counsel states that the petitioners do not wish to pursue the matter any further and that the petitioners would avail the appropriate statutory remedy.
