¶1Heard Mr. Vinay Kumar Mishra, learned counsel for the petitioner, Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State-respondents and Mr. Rameshwar Prasad Shukla, learned counsel for the respondent-Gram Sabha.

¶2In compliance of the order of this Court dated 6.10.2023, instruction dated 25.10.2023 is placed before the Court by learned Additional Chief Standing Counsel for the State-respondents, which is taken on record.

¶3Learned Additional Chief Standing Counsel on the basis of instruction dated 25.10.2023 submitted that the plot in dispute i.e. 133 area 0.723 hectare is recorded as pond in the revenue records. He further submitted that C.H. Forms 41 & 45 also demonstrate that the plot in dispute is recorded as pond. He next submitted that the fisheries lease has been executed in favour of one, Reeta wife of Sanjay for 10 years on 21.10.2023, as such, no cause of action survives in the matter and the writ petition is liable to be dismissed.

¶4In reply, learned counsel for the petitioner submitted that the suit for injunction filed by the Gaon Sabha was decreed by the trial Court on

13.10.1958 but in appeal the decree of the trial Court has been set aside and the suit filed by the Gaon Sabha has been dismissed. He further submitted that the pond in question is the private pond of the petitioner, as such, the same cannot be auctioned by the state authorities under U.P. Revenue Code,2006 and the rules framed there under.

¶5I have considered the argument advanced by learned counsel for the parties and perused the records.

¶6There is no dispute about the fact that Plot No. 133 area 0.0723 hectare is recorded as pond and 10 years fisheries lease has been executed in respect to the plot no.133 in favour of one Reeta wife of Sanjay.

¶8In the view of the execution of fisheries lease executed on 21.10.2023 in favour of one Reeta wife of Sanjay, petitioner is not entitled to the relief claimed in the writ petition rather petitioner can avail remedy under Rule-59 of U.P. Revenue Code Rules, 2016 in respect to the lease executed on

21.10.2023.
