The applicant was enlarged on interim bail by this Court vide order dated 17.7.2023. After the grant of interim bail to the applicant, the report of FSL has been received, which has been brought on record by learned AGA, which shows that the applicant is biological father of the child born to the victim. In view of the above, the interim bail granted to the applicant vide order dated 17.7.2023 passed by this Court is confirmed, subject to the applicant depositing F.D.R. of Rs.2,50,000/- before the court below in the name of minor son born to victim represented through his natural guardian and mother/victim, within two months. Since the child is minor, the aforesaid amount shall be deposited in a fixed deposit of nationalized bank bearing maximum rate of interest and it shall abide by the final decision of the trial court. The aforesaid deposit will not prejudice the rights of the applicant in trial. In case the applicant complies the aforesaid order within two months from today, he shall remain on bail on same terms and conditions as given in earlier interim order dated 17.7.2023 during prendency of trial. In case of default bail granted to applicant shall stand cancelled and he shall be taken into custody after two months from today. Bail application is allowed as aforesaid.
