Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. This writ petition has been filed interalia for the following relief:- "A) Issue an appropriate writ order or direction in the nature of certiorari quashing the impugned order dated 28.06.2023 passed by respondent no. 2 issued by respondent no. 3 with covering letter dated 08.08.2023 (Annexure No. 12 to the writ petition). B) Issue an appropriate writ order or direction in the nature of mandamus directing the respondent no. 2 to initiate proceeding against respondent no. 5 on the complaint of the petitioner and also take legal action against guilty persons." This is a complainant's petition and the petitioner has made complaint against the against the respondent no. 5 who is Fair Price Shop dealer. Learned Standing Counsel on the other hand submits that the petitioner has no locus to file such petition, therefore, this petition is not maintainable. In support of his contention, he has relied upon the judgement of this Court in the case of Lakki Sonkar vs. State of U.P. and 5 others passed in Writ -C No. 11528 of 2023.
