¶1Heard learned counsel for the applicant and learned A.G.A. for the State.

¶2By means of this application under Section 482 Cr.P.C., the applicant has preferred for quashing of order dated 14.06.2023 and stay the proceedings of Complaint Case No.3479 of 2015 (Subhash Chandra Pandey vs. Audyogik Utpadan Samiti) under section-138 N.I. Act, Police Station-Majhola, District-Moradabad pending in the court of learned Presiding OfÏcer, Additional Court, 138 N.I. Act, Moradabad.

¶3At the very outset, learned counsel for the applicant submits that the applicant is willing to settle the dispute by paying the cheque amount, therefore he does not want to press this application at this stage and he may be permitted to withdraw this application with liberty to move an appropriate application before the trial court.
