¶1Heard Sri Saurabh Kumar Srivastava, learned counsel for the petitioner, learned Standing Counsel for the respondent nos. 1 & 3, Shri Swapnil Sinha, learned counsel for the respondent no. 4 and Mohd. Afzal, learned counsel for respondent No. 2.

¶2This writ petition has been filed seeking issuance of a writ of mandamus commanding the respondent nos. 2 and 3 i.e. UPRERA and District Magistrate, Gautam Budh Nagar, to enforce recovery certificate dated 24.12.2022 for recovery of Rs. 22,08,255.90, from the respondent no. 4, expeditiously, within a time frame fixed by this Court.

¶3At the very outset, learned counsel for the respondent no. 4 submits that he has brought the post dated cheques and is willing to pay the amount as sought to be recovered under the Recovery Certificate.

¶4Let all the parties appear before the respondent no. 3 i.e. District Magistrate, Gautam Budh Nagar, on 06 November, 2023 for the aforesaid purpose.

¶5It is made clear, that in case the cheques, submitted by the respondent no. 4, get bounced the petitioner would be at liberty to take all necessary actions against respondent no. 4, in accordance with law, and even this Court may draw contempt proceedings against respondent no. 4.
