¶1Heard learned counsel for the applicant, learned AGA and perused the record.

¶2The accused-applicant seeks bail in Case Crime No.735 of 2020 under sections 419, 420, 467, 468, 471 IPC,P.S. Cantt. District Varanasi.

¶3The FIR in question was lodged against two persons including the applicant alleging that the applicant has misused the stamp of the police authorities and has got the armed license renewed for which the steps have already been taken for canceling the license.

¶4It is argued that the co-accused Meraj Ahmad Khan has been enlarged on bail vide order dated 04.02.2021.

¶5Considering the fact that the allegations against the applicant pertain to misuse of stamp for obtaining the renewal of the arms license, the same has to be established by means of a documentary evidence. The applicant is in custody since 04.01.2023 and has no criminal history except for another case which has arisen out of same transaction coupled with the fact that the applicant there is noting on record to demonstrate that the applicant if enlarged on bail can adversely affect the trial, the applicant is entitled for the bail. Thus the bail application is allowed.
