Heard Sri Lal Behari Yadav, learned counsel for the appellant and the learned A.G.A. for the State and also perused the record. On 20.9.2023 the following order was passed: "Sri Lal Behari Yadav, learned counsel for the appellant reveal the fact that appellant Surya Bhan Yadav has died during the pendency of the appeal. Sri Yadav, learned counsel for the appellant has received the information to the fact from the pairokar. CJM, Mau is directed to inquire into the matter by filing credible document regarding the aforesaid fact. Let this exercise be completed within next three weeks. List this matter once again in week commencing 30.10.2023 along with report of CJM, Mau." From perusal of the record it reveals that in compliance of the aforesaid order dated 4.9.2023, learned Chief Judicial Magistrate, Mau has sent its letter dated 12.10.2023, which indicates that appellant Surya Bhan Yadav died on 5.7.2023.
