¶1Heard learned counsel for the parties and perused the record.

¶2The instant petition is preferred by the petitioner seeking a writ of mandamus directing respondent no. 2, Tehsildar, Tehsil Raja Talab, District Varanasi to remove the illegal encroachment over chak road as Plots No. 670, 672, 674 and Chak Nali as plot no.

680.

¶3On the instructions received, learned Standing Counsel informs that on Plots No. 670, 674 and 680 no encroachment has been found. So far as Plot No. 672, illegal encroachment on the part thereof has been found in respect whereof appropriate proceedings under Section 67(1) of U.P. Revenue Code, 2006 has been initiated against the encroachers.
